Subpoena in the state aid case

The Danish Gambling Authority has received information that a subpoena has been filed on 30 November 2011 to the European Court’s office on behalf of Dansk Automat Brancheforening (the Danish trade organisation for gaming machines) against the EU Commission in relation to the Commission’s decision of 20 September 2011 according to which the duties in the Gambling Act are not in conflict with EU’s state aid rules.

At the same time a request for interim measures has been submitted – that is a stay of execution. The Danish Gambling Authority would like to announce that the Danish liberalisation of the gambling market will enter into force as planned on 1 January 2012. The fact that a court case has been filed does not change this. The court case does not cause concern for the Danish Gambling Authority or the Danish Ministry of Taxation.
